As the client, (‘You/Your’) agree with Santa Bay Photos/Purdie Photography will create and supply digital only portrait photographs with Santa on the beach (‘the Services’) in accordance with the details on the order form (‘the Agreement’). Please note that by completing the Booking form and paying the relevant fee you acknowledge acceptance of these terms and conditions.
Santa Bay Photos/Purdie Photograph is a slimmed down, one beach boutique version of the previous Santa Beach Photos brought to you by one of the 3 partners of the original business. Because of these spots are limited and we cannot be held responsible if you leave booking too late and miss out. Endeavour to get in early and not try to change your booking later in the season as you might find we are fully booked with no vacant spots to rebook into.
Your Responsibility:
It is Your responsibility upon booking with Santa Bay Photos/Purdie Photography that you take note of Your booking with a phone calendar reminder, keeping Your booking email and any other form of reminder You need, so You turn up on your booked day at the correct time slot. Please turn up early. We will send out reminder texts before your booking but it’s up to You to record your booking time and date. If You do not receive a booking reminder, You must contact us to confirm Your booking as no booking email can mean a glitch in the system and/or double bookings. Check Your junk mail folder first. Also watch the Santa Bay Photos Facebook page for weather updates and reminders of the days we are shooting. It is also your responsibility to know where you are going (Portsmouth Place beach off Masthead Drive in Raby Bay, Cleveland, Brisbane, Australia). Please make note of this new address and don’t turn up to the old Beach 1 and Beach 2 that we used to shoot at and wonder why you can’t see Santa and the team.
We cannot be held responsible for people being photographed that do not co-operate when being photographed. We try our best to get everyone smiling and happy but this is not always possible especially with babies, children, dogs, older people, anyone with an issue with Santa, or those with special needs. It’s your responsibility to speak to your children about Santa before arriving and the same goes for reluctant husbands or teenagers who don’t want to be photographed.
Dogs:
Dogs must be on a leash and under control at all times. They are not allowed to go onto the sand as council restrictions prohibit this. Council inspectors do walk the beaches on the weekends. If any fines are issued to you for you letting your dog on the sand or running off leash, you will solely be responsible for this, not Santa Bay Photos/Purdie Photography. There are trees nearby to the sand where you can tie up your dogs if your family wishes to venture further onto the sand area down by the water for some photos.
Payment:
On payment via Santa Bay Photos/Purdie Photography website, Your booking with Santa for Your Beach Photos will be confirmed. If a third party pays for the Services the Agreement remains personal to and binding on you.
Bookings can be transferred to another party upon notification via email i.e. (in case session is given as a gift or if you are unable to attend your session). Just correspond with us so we know who is being photographed and where to send the images after the shoot.
Image Quality and Delivery:
You will receive a minimum of 6 images supplied at full resolution from a 45mp camera, depending on the number of people being photographed with Santa in several different poses and these will be sent after your session with a photo link in an email. Contact us if the images aren’t received within 3 working days. Check your junk mail folder first as it may be there. You don’t need an account to download the Google Drive. The link is safe to click. If you do not click the link to view your images, you won’t be able to have your images, as this is the only way we can transport big size files to you over email. If you have trouble, please ask a friend to help before you contact us.
If your group are easy to photograph you may receive more than 6 or 12 images in your Google Drive album afterwards but this is not guaranteed due to factors out of our control.
Cancellation:
If You cancel your Santa Bay Photo Session more than 24 hours’ notice prior to Your Beach Photo booking with Santa, Santa Bay Photos/Purdie Photography will happily refund all monies to You less an automatic $10 admin fee. You can rebook freshly at a TryBooking link found on our Book Now page to a time slot that suits you.
Refunds with TryBooking will take 5-10 days to appear in your account.
If by chance you don’t turn up on the day at the last minute due to the weather or other circumstances, your spot can’t be re-booked so you won’t receive a refund. If no notice is given, and You just fail to show up, Your monies will be fortified. We have costs to cover plus new council fees to be on the beach.
Creative Freedom:
Santa Bay Photos/Purdie Photography shall have creative freedom as to the choice of locations, props and poses used for the photographs. Santa Beach Photos photographer’s will be able to use their creativity for image poses. Images taken shall be final but we shall endeavour to honour requests but cannot guarantee that photographs will incorporate any specific background, location or group arrangement. If it is very windy, some props may not be able to be used for your photo session. We no longer have the blue or red set but a new updated and fresh set.
Copyright:
Unless specified otherwise, the copyright in all photographs will be retained by Santa Bay Photos/Purdie Photography and the photographer who is photographing you. If copyright is assigned to You or not, unless otherwise specified on You hereby provide Santa Bay Photos/Purdie Photography with a sole, perpetual and irrevocable license to use the photographs for marketing purposes, social media, our website use and any forms of publication.
Weather Conditions:
Should an unpredictable weather event occur, you will be phoned and able to choose the first vacancy suitable to your Santa Group. If an alternative date cannot be made, OR you will be refunded all monies paid under this Agreement. Santa Bay Photos/Purdie Photography shall not be liable to You for any direct, indirect or consequential loss or damages and total liability shall not exceed the fees You have paid under this Agreement. We cannot guarantee perfect weather for your shoots with light winds and gentle sunshine, but we will do our best with whatever light and weather conditions we have available to us at the time of your booking. Please monitor your mobile phone on the day of the shoot in case we need to contact you. If you do not answer, we will leave a message so please endeavour to call us back asap so we can rebook you. Failure to do this, may mean you miss out on a rebooked spot as we are limited by time, sunsets, and available shooting days leading up to Christmas.
Issues or Complaints:
If you have any issues at all, please contact us for a resolution rather than going to the internet to complain or leaving a bad review. No threats, abusive behaviour in words either written or verbal will be tolerated towards anyone on staff at Santa Bay Photos/Purdie Photography including Santa, helpers or photographers.
Privacy Information:
Santa Bay Photos/Purdie Photography, have adopted the following privacy policy as part of our commitment to protect personal information (“Personal Information”) which you provide to us by completing such input areas on the Trybooking form.
We will not sell, trade or rent your Personal Information to others. With your permission, we may use your Santa Bay Photo images for marketing purposes. Please advise if you are opposed to us using your images on social media or for marketing purposes. Advise in writing to us or on the ‘additional comments’ section of the booking form. We will follow the appropriate legal requirements to ensure that no third parties see your Personal Information. We will definitely not share your Personal Information with any third party for commercial purposes or otherwise.
Your email address may be collected and stored for the purpose of sending out a Mailchimp newsletter at the start of each season for our valued past clients to rebook with us before the general public, but the email address will never be sold or put on any other lists, and you can unsubscribe at any time at the bottom of the email.
Your mobile phone number is collected to make contact with you regarding your booking but will not be used for any other purpose.
It is your responsibility to give us the correct and working mobile phone number and not a landline. Sometimes Trybooking keeps old information so it is your responsibility to check the information you or your computer/phone are inputting.
You must also give us a correct and working email address. Some people give us work emails and the spam filters catch our emails and some delete them. A personal email is better than a work one (especially a school email address), and Hotmail accounts are the worst for trashing business emails so please be aware of this and check your spam folders before advising you haven’t received your images.
